Recall that, during the Presidential Election Petitions Court proceedings, Peter Obi’s Lead Counsel, Livy Uzoukwu (SAN), claimed that Prof. Yakubu had been evading being served a subpoena. However, Festus Okoye dismissed Obi’s statement during the interview, stating that those individuals who did not receive a response to their subpoenas had failed to follow the proper legal procedures.
In a recent interview on Channels TV, Festus Okoye, the INEC National Commissioner in charge of Voter Education/Publicity, has responded to the criticism leveled by Peter Obi, the Labour Party’s presidential candidate for the 2023 elections, against the INEC Chairman, Prof. Mahmood Yakubu.
According to Festus Okoye from the video (12:50-15:18): “The Chairman of the commission answered all the supoena’s that were issued and directed at him. He doesn’t necessarily need to answer in person. What the tribunal requires is that a particular document required by the petitioners or by the respondents should be produced and that particular document was produced, it does not matter which officer of the Commission produces the documents. Obi and his team should follow due process before coming out to tell the media a different story. All subpoena that followed due process were attended to”.
According to Okoye, the due process for serving a subpoena must be adhered to, and anyone who did not receive a response from the INEC Chairman likely did not follow the correct protocol. By implying this, he indirectly refuted Obi’s allegations that Prof. Yakubu was avoiding being served the subpoena.
In his response, Okoye appeared to defend the INEC Chairman’s actions and highlight the importance of following legal procedures to ensure effective communication with relevant parties involved in the court proceedings.
