Chief Olisa Agbakoba SAN, former President of the Nigeria Bar Association NBA, has claimed that the fate of President-elect Bola Ahmed Tinubu should be decided before his inauguration on May 29th.

In an interview with Arise Tv news, Agbakoba argued that it made no sense for Peter Obi, who had filed a petition that Tinubu should not be inaugurated, to wait for 180 days. He stated that the tribunal had to rise to the occasion and indicate who truly won the election according to the law.
Hear him: “There is a certain unfairness for petitioners to challenge a President-elect in Nigeria. Let the Judiciary give it a go and see whether we will not accomplish what I have described in my letter. Nothing in the constitution says you must take the 180 days before tribunal. You can even go on the first day”.
Agbakoba clarified that once a candidate filed a petition, they had to be prepared for pre-entry strikes, which could be done within seven days. He expressed concern that the political environment was overheated and suggested that the petitions be resolved before the handover on May 29th. He emphasized that there was no constitutional requirement to wait for 180 days before the tribunal could sit on an election petition, and a petitioner could even go on the first day.

The former Nigeria Bar Association President believed that there was a certain unfairness in challenging a President-elect in Nigeria, and the judiciary should determine the petition’s outcome before the inauguration. Agbakoba maintained that nobody waited until the end of the 180-day timeline to file their papers, and speed was necessary to resolve the current political disputes.
